On 24th July 2001 your
Franchisee Committee with their advisor Mr Ken Schurgott of Thomson
Playford Solicitors and Enviro’s advisor Mr Robert Walsh of PBA Advisers
met with the ATO in Adelaide.
The meeting was productive with the
representative stating:
- They believed the ATO was incorrect
in presuming the franchisees were not part of a bona fide business
activity and had based their argument in their position paper (the
letter sent to franchisees) on incorrect assumptions and had acted
prematurely before even inspecting the woodlot site to see that
there were trees planted achieving projected yields.
- That the Prime Minister’s press
release and subsequent press releases by the Commissioner of
Taxation allowed in relation to agricultural projects:
- A hold on Objection and
Collection Actions by the ATO.
- Reduction of interest on
outstanding tax debts.
- Relief for people facing
financial difficulty.
and that these policies should be
applied to Enviro Systems franchisees.
- That the franchisee committee and
Enviro in conjunction/liaison with its advisors and the ATO would
seek clarification from the ATO on various matters concerning the
franchisees:
- Tax position.
- Settlement options.
- Effect on ASIC re-structuring on
settlement options.
- Once clarification from the ATO had
been received on various matters, the Franchisee’s Committee
commissioned an updated tax opinion in liaison with Enviro to
inform franchisees of their exact position and options.
- Once the franchisees were fully
informed of their position, negotiate a settlement on behalf of
those growers that wished to settle under the guidelines of the
cash outlay basis.
